Australia’s Student and Temporary Graduate visa family rules are back in the spotlight following a proposal from One Nation to restrict family members accompanying temporary visa holders.
The proposal has attracted attention from international students and graduates who are planning to bring a partner or dependent children to Australia, particularly those relying on the Subclass 500 Student visa and Subclass 485 Temporary Graduate visa as part of a longer-term migration pathway.
But there is an important distinction:
This is a One Nation proposal. It is not a confirmed change to Australian Government visa policy.
What is One Nation proposing for visa family members?
One Nation has called for tighter restrictions on family members accompanying international students and temporary graduates to Australia.
The debate has intensified following recent attention on the number of secondary visa holders attached to temporary graduate visas.
For prospective migrants, however, the important question is not simply what has been proposed. It is whether the current Student and 485 visa family rules have actually changed.
At this stage, the answer is no as a result of this proposal.
Can Student Visa holders still bring family members to Australia?
Under the current Subclass 500 Student visa framework, eligible applicants can include members of their family unit in their visa application.
This can include an eligible partner and dependent children.
There are also circumstances where eligible family members can apply later as subsequent entrants, subject to the relevant requirements.
The current arrangements are outlined by the Australian Department of Home Affairs on its Subclass 500 Student visa page.
The One Nation proposal has not, by itself, removed these existing family arrangements.
Can 485 Visa holders still include a partner or children?
The Subclass 485 Temporary Graduate visa also currently provides pathways for eligible family members.
Depending on the circumstances, eligible partners and dependent children may be included, and family members may also be able to join the primary visa holder later through the relevant subsequent entrant arrangements.
The Department of Home Affairs provides the current requirements through its Temporary Graduate visa information.
Again, there is currently no confirmed Australian Government policy arising from the One Nation proposal that removes family members from the 485 visa.
Why does the One Nation proposal matter?
For applicants, the immediate issue is not that the rules have suddenly changed.
The bigger issue is planning risk.
If your Australian migration strategy involves studying in Australia, moving onto a 485 visa and bringing your partner or children with you, family arrangements can affect much more than the initial visa application.
They can affect your timing, costs, study decisions and longer-term migration strategy.
With migration policy continuing to attract political attention, applicants should avoid building a multi-year plan around assumptions that today's settings will necessarily remain unchanged.
That does not mean rushing into an application because of an unconfirmed proposal.
It means understanding what the rules allow today and how your pathway could respond if those settings change.
Should Student or 485 Visa applicants apply earlier?
There is currently no basis to say that One Nation’s proposal will become Australian Government policy.
Applicants should therefore be cautious about making major decisions purely because of political commentary.
However, if you already intend to study, graduate and build a longer-term future in Australia with your family, delaying your planning indefinitely can create its own risks.
A migration strategy should consider:
- when you intend to commence study
- whether your partner or children will accompany you
- your potential 485 eligibility after graduation
- your longer-term skilled or employer-sponsored options
- what alternatives are available if migration settings change
The objective is not simply to obtain the next visa. It is to understand where that visa fits into your longer-term Australian migration pathway.
