eVisitor Visa Application Requirements: What Has Changed?

A new legislative instrument governing the eVisitor visa (subclass 651) application arrangements commenced on 29 September 2026.

Importantly, the update does not materially change the existing application process. The new instrument replaces the previous 2016 instrument while substantially maintaining the existing form and manner requirements.

Applicants must continue to use Form 1362 (Internet) and lodge their application online in accordance with the current requirements.

The eVisitor visa is a free online visa available to holders of eligible passports specified by the Australian Government. It generally allows multiple visits to Australia for tourism or business visitor purposes, with stays of up to three months per visit during a 12-month period.

What Is the 'Form and Manner' Requirement?

Under Australian migration law, visa applications must be made using the approved form and in the prescribed manner.

For the eVisitor visa, these requirements determine how an application must be submitted. The new Migration (Arrangements for eVisitor Visa Applications) Instrument 2026 (LIN 26/061) confirms that applicants must use Form 1362 (Internet) and lodge the application as an internet application.

What Has the 2026 Update Confirmed?

The new legislative instrument commenced on 29 September 2026 and replaces the previous instrument governing eVisitor application arrangements.

However, this is primarily a legislative update rather than a major change to the way applicants lodge an eVisitor application. The current online application arrangements have been substantially maintained.

For most applicants, there is therefore no significant practical change to the application process.

Who Is Affected?

The update is relevant to:

  • Eligible passport holders planning to apply for an eVisitor visa for tourism or permitted business visitor activities.
  • Migration professionals assisting clients with eVisitor applications.
  • Businesses or conference organisers facilitating short-term visits to Australia.

Applicants should continue to follow the current online application process and ensure they meet all relevant visa requirements before lodging.

Practical Steps for Applicants
  1. Check that your passport is eligible for the eVisitor visa.
  2. Use the current online application process and follow the latest Department of Home Affairs instructions.
  3. Ensure the information and supporting documents provided are accurate and appropriate for your intended visit.
  4. If you are unsure whether an eVisitor is suitable for your circumstances, obtain advice before lodging your application.
Why Form and Manner Requirements Matter

Although the 2026 update does not materially change the current eVisitor application process, form and manner requirements remain legally important.

Australian migration law requires visa applications to satisfy prescribed requirements in order to constitute a valid application. Using the correct application process is therefore an important part of visa compliance.

If your travel circumstances are more complex — including previous visa refusals, immigration history, business activities in Australia or uncertainty about the appropriate visitor visa — professional advice before lodging may help reduce avoidable application issues.
